By accessing or using the Swiss Elite Models platform (the "Platform"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree with any part of these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Platform at least 14 days before they take effect. Continued use of the Platform after such notice constitutes acceptance of the revised Terms.
You must be at least 18 years of age to use the Platform. By registering, you represent and warrant that you are of legal age and have the full legal capacity to enter into a binding agreement. The Platform is intended for use in Switzerland and the European Union. We reserve the right to restrict access from other jurisdictions.
To access certain features, you must create an account by providing accurate and complete information. All registrations are subject to review and approval by our team. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate any account that violates these Terms or that we reasonably believe poses a security risk, without prior notice or liability.
You agree to use the Platform in a lawful, respectful, and appropriate manner. You must not: use the Platform for any illegal purpose; harass, abuse, threaten, or intimidate any other user or model; upload or transmit content that is defamatory, obscene, or infringes third-party rights; attempt to gain unauthorized access to any part of the Platform or its systems; use automated tools, bots, or scrapers to access the Platform; impersonate another person or misrepresent your identity; circumvent any security or access control measures. Violation of these rules may result in immediate account suspension or termination.
Model profiles are curated by our team and the models themselves. While we strive for accuracy, we do not guarantee that all profile information, photos, or descriptions are entirely accurate or up to date. Models retain ownership of their personal content (photos, videos, descriptions). By uploading content to the Platform, models grant Swiss Elite Models a non-exclusive, worldwide licence to display, distribute, and promote such content on the Platform and in marketing materials. This licence is revocable upon deletion of the content or account closure, subject to reasonable processing time.
The Platform offers VIP subscription plans granting access to premium content and features. Subscription fees are displayed in Swiss Francs (CHF) or Euros (EUR) depending on your preference. By subscribing, you authorize automatic recurring billing at the applicable rate until you cancel. You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period — no prorated refunds will be issued. We reserve the right to adjust subscription prices with at least 30 days' notice. If you do not agree with a price change, you may cancel before the new rate applies.
The Platform allows registered members to submit booking requests to models. A booking request is an expression of interest and does not constitute a binding agreement. Models are free to accept or decline any request at their discretion. Swiss Elite Models acts solely as a facilitator and is not a party to any arrangement between members and models. All further communication and arrangements are conducted outside the Platform at the parties' own responsibility and risk.
All content on the Platform — including but not limited to text, graphics, logos, icons, images, audio, video, software, and the overall design — is the property of Swiss Elite Models or its licensors and is protected by Swiss and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Platform content without prior written consent. The Swiss Elite Models name, logo, and all related marks are registered trademarks. Unauthorized use is strictly prohibited.
Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. We comply with the Swiss Federal Act on Data Protection (nFADP/nLPD) and the EU General Data Protection Regulation (GDPR) where applicable. By using the Platform, you consent to the collection and processing of your data as described in our Privacy Policy.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. To the maximum extent permitted by Swiss law, Swiss Elite Models, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of profits, data, or goodwill. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Swiss Elite Models and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your use of the Platform; your violation of these Terms; your violation of any third-party rights; or any content you submit or transmit through the Platform.
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may delete your account at any time through your account settings or by contacting our support team. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall remain in effect.
We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. This includes, but is not limited to, features, content, subscription plans, and pricing. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any dispute arising from or in connection with these Terms or your use of the Platform shall be submitted to the exclusive jurisdiction of the courts of Geneva, Switzerland. Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.
